The free trial period of your subscription lasts for the period specified on the platform. We determine eligibility for free trials in our sole discretion and may restrict eligibility to prevent abuse of free trials. We reserve the right to revoke the free trial at any time and suspend your account if we determine that you are not eligible. Free trials are only available to new account holders. If you do not pay the subscription fee for the subscription you have chosen (fee) at the end of the free trial period, access to the Platform for you and your authorized users will end at the end of the free trial. On the day you make the payment (Payment Date), your subscription will begin and the Free Trial will end.6.2 If you have chosen a monthly subscription option, your subscription will renew on an ongoing monthly basis, unless your subscription is suspended or cancelled in accordance with these Terms and you will be charged the same fee on a continuous monthly basis from the date of payment. Without limiting your rights under Australian Consumer Law, you may cancel your subscription at any time in accordance with the “Cancellation of Subscriptions” clause of these Terms, but termination will only take effect at the end of the monthly period for which you paid the fee. 6.3 If you have chosen an annual subscription option, your subscription will renew annually on an ongoing basis, unless your subscription is suspended or cancelled in accordance with these Terms and you will be charged the same fee on each anniversary of the date of payment. We will send you a reminder email 7 days prior to your annual subscription renewal date. Without limiting your rights under the Australian Consumer Act, you may cancel your subscription at any time in accordance with the “Cancellation of Subscriptions” clause of these Terms, but termination will only take effect at the end of the one-year period for which you paid the fee.

6.4 The payment methods we offer for the Fees are specified on the Platform. You acknowledge and agree that we have no control over the third party`s actions and that your use of the third party`s payment method may be subject to additional terms and conditions.6.5 You must not pay or attempt to pay the fees fraudulently or illegally. If you make a payment by debit or credit card, you warrant that you are authorized to use the debit card or credit card for payment.6.6 You agree that from any amount payable to you under these Terms, we may set off or deduct any amount you owe us (whether under these Terms or otherwise).6.7 We do not retain any details of Credit Card: and all payment information is collected and stored through our third party payment processor.6.8 Changes to your subscription: 6.9 Upgrade: If you wish to upgrade your subscription to another tier, you must notify us in writing through your account. The upgrade will take effect immediately upon our acceptance of your request to upgrade your account and we will charge you the prorated fee increase for the remainder of the period until your next payment date.6.10 Downgrade: If you wish to upgrade your subscription to another tier, you must notify us in writing through your account. If you upgrade from an annual subscription to a monthly subscription, the downgrade will take effect immediately after we accept your request to downgrade your account, and the difference in fees will be credited to your account to be used for future monthly payments. If you upgrade from a monthly subscription tier to a cheaper monthly subscription tier, the downgrade will take effect on the next payment date. Under no circumstances will we refund fees once they have been paid. 6.11 We may need to change from time to time what is available as part of your subscription (e.g. inclusions, exclusions, updated features). If we change what is available as part of your subscription, we will notify you 30 days in advance. After 30 days, we will apply the changes to your subscription.

If the changes materially and adversely affect your use of the Subscription, you may terminate your Subscription in accordance with the “Cancel Subscriptions” clause.6.12 We may need to change the fees from time to time. If we change the fees, we will notify you 30 days in advance. After 30 days, we will apply the updated fees to your subscription. If you are not satisfied with the updated fees, you may cancel your subscription in accordance with the “Cancel Subscriptions” clause. You can restore a cancelled subscription at any time, even if your previously cancelled subscription is still active. You will not be charged until the currently active subscription expires and until the charges are due for the next period. Your personal information is private only to the extent that you keep it private. If you post personal information on the Site, Wink has no control over how another party might use that information. You can access your personal data at any time by sending an e-mail to Wink at [email protected].

If you choose to pay by direct debit, you agree that we may charge you on the first day of the applicable subscription period. We will confirm the mandate by email once you have registered and inform you in advance of any future charges after the initial fee. 2.1 You agree to these Terms by ticking the box, clicking “I agree”, registering on the Platform or using the Platform.2.2 We may amend these Terms at any time by notifying you in writing. By clicking “I agree” or continuing to use the Platform after notification or 30 days after notification (whichever comes first), you agree to the modified terms. If you do not agree with the change, you may cancel your subscription in accordance with the “Cancel Subscriptions” clause.2.3 We may use Google Analytics and Maps services, including Google Analytics and Maps APIs. Your use of Google Analytics and Google Maps is subject to the applicable Google Additional Terms of Service.2.4 Subject to your compliance with these Terms, we grant you and your Authorized Users a personal, non-exclusive, royalty-free, revocable, worldwide, non-transferable license to use our Platform in accordance with these Terms. Maintenance and development of the Wink platform is expensive. Unlike companies that sell user data to offset the costs associated with offering free services, Wink relied solely on the modest one-time fees from selling hardware.
